Labelling a Disbeliever as a Disbeliever (Kafir)

Question
Zaid claims that we should not refer to even a kafir as a kafir. What does he mean? Should Muslims not refer to a kafir as a kafir when discussing among themselves or should they not refer to him as a kafir in front of him? Please enlighten us with the ruling. Also, which sects do we consider to be kafirs? Answer and be rewarded.
Answer
Zaid’s claim is incorrect and futile. It is necessary for him to repent. A kafir shall be considered a kafir and referred to as a kafir; and Muslims shall be referred to as Muslims. There is an erroneous saying on the tongues of the ignoramuses: “A kafir should not be referred to as a kafir because we are unaware of his final state - what do we know? He may become a Muslim in the end.” These fools do not understand that a kafir is referred to as a kafir because of his kufr [infidelity]. When he becomes a Muslim, we will no longer refer to him as a kafir. If that is the case, we should not refer to a Muslim as a Muslim because we are unaware of his final state, what if – Allah forbid – he dies upon kufr? Allah forbid! Only those who are Sulh-kul [1] utter such statements. They eat the meat of cows, have names like those of Muslims, do everything Muslims do, they act like Muslims superficially, but utter remarks of kufr like those of a disguised hypocrite: “Consider them to be Muslims, label them as Muslims, even the kafirs, consider them as Muslims too.”
لا حَوْلَ وَ لا قُوَّةَ اِلَّا بِاللّهِ
This is their [so called] new Shari’at. The pristine Shari’at rules that a kafir shall be referred to as a kafir. The hypocrites who were with the Messenger of Allah sallAllahu ‘alayhi wa sallam, not only did they pray and fast, they fought in the battles alongside the Messenger of Allah, they would kill kafirs, however, Allah unveiled their hypocrisy. The Qur’an referred to those evildoers as kafirs. The Messenger of Allah removed them one by one from the Masjid, saying: ‘leave, you are a hypocrite.’ One hypocrite uttered that Muhammad informs us that the lost she-camel of so and so is in a particular valley, what does he know about the unseen? Allah informed the Messenger of it and also said, “And if you ask them, they will say, ‘We were just joking and playing.’” [2] In reply to these hypocrites, Allah says in the Qur’an, “Do not make excuses, you have disbelieved after your belief.” [3]
All religions apart from the religion of Islam are infidels, and those who claim to be Muslims but then reject the fundamentals of the religion, they too are infidels. Such as: the Qadyani, the Deobandi, the Wahhabi, the Rafdi etc.

Tribute to Huzur Mufti e Azam
A lot has been written about Mufti Azam e Hind and a lot will be written, in fact; it will continue to be written.
Rather, I say, without any doubt, that whatever has been written or whatever will be written – all of it will not do justice to his sublime status.
All praise to Allah, I have been blessed to be in his company continuously for 11 years, even in his prime (meaning from the ages of 35 to 40): in particular, as a dweller and also as a traveler.
Mufti Azam e Hind’s life is split into 5 parts –
- Childhood,
- Studying and graduation,
- During the life of Ala Hazrat,
- After the passing of Ala Hazrat until becoming the Sajjadah Nasheen
- And finally from becoming Sajjadah Nasheen to the end of his life.

Mufti and Faqih
To become a Mufti nowadays is seen as very easy. It is famously known that any layman can issue a fatwa simply by referring to Fatawa Razaviyyah and Bahar e Shari’at. However, only the people who have given service in a Dar ul Ifta understand the difficulty of being a Mufti and Faqih.

Once Mufti Azam e Hind presented his Fatwa to some scholars to check and verify. Every scholar verified the Fatwa and stamped it ‘The correct answer’ or verbally verified it. Nevertheless, when the Fatwa reached Muhaddith-e-Kichochwi, Allama Sayyid Muhammad Ashrafi Jilani, he became extremely pleased and joyfully verified it with “The ruling in this Fatwa is by a scholar who is followed: therefore, it is necessary for us to follow”.
Why? I (Mufti Mujeeb Ashraf) say that whenever Mufti Azam Hind used to write a Fatwa, the same method as Ala Hazrat was adopted. Not only would he mention the rule, he would in fact include the reference and proof to satisfy the questioner.

Priority of Obligatory over Voluntary Actions
In a certain area within a city, an individual invited Mufti Azam e Hind to his residence. When Mufti Azam e Hind went to sleep, the host stayed awake. Hazrat never woke up to recite Tahajjud. After the Fajr Azaan, as per my habit, I presented myself in the court of Mufti e Azam and awoke his eminence. He performed salah with congregation and after having breakfast, we left the place. Thereafter, we came to hear that the host began to say that people claim he (Mufti Azam e Hind) is an esteemed personality, but I did not see anything unique in him: he did not even pray Tahajjud. Consequently, an illness overcame him and his entire property, belongings and wealth all burnt down. Thousands of monetary notes which were in the house were reduced to ashes! Only the clothes on his body remained! With this loss, he became severely depressed. The Ulama warned him and told him that you have disrespected a true Wali of Allah and [so face the consequences of your error]. [Realising his error, the host sincerely repented].
After a few years, Mufti Azam e Hind visited the very same area again and the very same host requested Hazrat to bless his [new] house a visit. The host also pledged allegiance at the hands of Hazrat.
Those who spend most of their time performing Nawaafil, Tahajjud, Ishraaq etc and those who engage themselves with Waza’if (litanies), they deceive themselves to think that they are from the saints of Allah. Further, people who look at these types of individuals also deem them as from the saints of Allah. However, those who are firm on the Fara’idh, Waajibaat and Sunan, such as Mufti Azam e Hind, continue to remember Allah; they do not think of themselves as Friends of Allah and neither are the public mislead by their appearance and actions.
Nevertheless, I am not lowering the value of actions such as Tahajjud, Ishraaq and other methods of remembrance to reach Allah. I am simply mentioning the best way to reach Allah. This is better understood from the following – I ask everyone, the method that Mufti e Azam used - i.e. being firm on the Fardh, Waajiib, Sunan and even the Mustahabaat, in fact staying away from Haram, even staying away from Makruh, in every way possible – his whole life was dedicated to spending time in helping the public, remembering Allah, writing fatawa, correcting or advising Muftis and ordering good/forbidding evil.
Is the aforementioned better, or is it better not to be punctual in the obligatory actions, being careless or heedless in abstaining from Haram/Makruh and instead spending your time in voluntary actions? The decision is left to you.

Spiritual Pilgrimage of Huzur Mufti e Azam
Narrated by Mufti Shareef ul Haq, alayhir rahmah:
Once a resident of Bareilly returned from Hajj and began to question people regarding when Mufti e Azam left for Hajj, and whether he has returned yet or not? The people informed him that Hazrat did not perform Hajj this year. They also told him that Hazrat lead the Eid prayer and we all prayed behind him. In confusion, the pilgrim asked “What are you all talking about? I saw Hazrat performing Tawaf (circumambulation around the Holy Ka’baa), I saw him in Masjid-e-Haram, Mina, Arafat and I even met him in all these places. I also saw him praying Salah in Masjid-e-Nabawi and even presenting his Salam in the court of the Prophet (endless peace and salutations be upon him).
Hearing this, everyone became shocked. However, they still continued to remark that it must surely be a misconception, for Hazrat did not leave to perform Hajj this year. The pilgrim reiterated, “It was not a misconception; I swear that I met him there, I kissed his blessed hands, talked to him and without doubt saw him presenting his Salam in the Masjid-e-Nabawi. The people told him once again that Hazrat did not perform Hajj this year. The pilgrim himself told me (Mufti Shareeful Haq) and I also heard this from many others.
When this pilgrim presented his self in the court of Mufti e Azam, Hazrat looked at him in happiness and smiled. The pilgrim sat and continued to look at Hazrat. Hazrat directed his attention towards the pilgrim and asked him regarding his journey to the two holy sanctuaries. Hazrat, in a calm and kind manner, said to the pilgrim that “not everything is supposed to be told to everyone: remember that”. Subsequently, the pilgrim became a disciple of Hazrat.

Spiritual Perception of Huzur Mufti e Azam
Mawlana Dr. Muhammad I'jaaz Anjum Latifi, the Teacher of Jaamia' Razviya Manzar-e-Islam Bareilly Sharif, narrates:
It is the year 1981. I reached Bareilly Sharif, alone, after a long journey from my home. I had an uncle living here whose name was Mawlana Akhtar Noori and it was a favourable coincidence for me that he met me along the way in Bareilly Sharif. The following day, I presented myself at the Tomb of Sayyidi AlaHadrat radi Allahu anhu. Ever since from this day I always presented my greetings at the Tomb of Sayyidi AlaHadrat during the mornings and evenings. Sometimes I would meet Huzur Mufti-e-A'zam in Raza Musjid. I used to greet him and kiss his blessed hands. In those times I had no special inclination towards him. I considered him as a pious person like every other pious man.
One day my uncle questioned me if I was a mureed of someone. I informed him that I am not as yet a mureed of anyone but my parents have become mureeds of a Pir Sahab of Kichowcha Sharif. My intention is also to pledge allegiance (become a mureed) to a Sayyid Sahab. The reason I stated this is because I have always heard and read the excellence and greatness of the Prophet's صلى الله عليه و سلم descendents. In short, my intention was not to become the disciple of Huzur Mufti-e-A'zam. My uncle tried to instill affection within me for Huzur Mufti-e-A'zam by informing me about his piety, selflessness and spirituality. He also motivated the fact that I shall not find a worthier and more God-Fearing Pir than him. Thereafter (when I did not heed his advices and requests) he discontinued encouraging me to become the Mureed of Huzur Mufti-e-A'zam.
Three weeks later there was no thought in my mind about becoming a mureed to anyone. The weather was surging with summer heat. The days were of Ramadaan. One day I woke up in the afternoon, performed Ghusl (bath) and prayed my Zuhr Prayer with the congregation. Then I started reciting the Holy Qur'an. The sun had declined and due to this the temperature dropped a little bringing along with it a cool waft of late afternoon breeze. My eyes drooped and while I was busy in the recitation of the Holy Qur'an, I slumbered onto the floor and slept.
When my eyes opened my condition was peculiar in a way that my heart felt a strange wave of tranquility. At that time I was the Imam of the Musjid of Ahmad Ali district of Bareilly Sharif. My inner being, as if a magnet, was drawing my attention towards Huzur Mufti-e-A'zam. My mindset was suddenly filled with a strange desperation and a resolved determination that I must become a mureed of Huzur Mufti-e-A'zam. I was astonished with my state of affairs and I kept questioning as to why, out of the blue, that I remember Huzur Mufti-e-A'zam? In this condition, I went to my uncle and requested him to request Huzur Mufti-e-A'zam to accept me as his mureed.
My uncle, undoubtedly surprised by my request, remarked: "I always motivated you to become his mureed but you did not pay any heed. And now, suddenly, without any premonition, why did you change your intention?"
I replied that I am myself stunned at my words and my heart is involuntarily being pulled towards Huzur Mufti-e-A'zam and my senses are encouraging me to go to him. Nevertheless, we immediately left the Musjid and travelled to the Saudagran district to Raza Musjid. It was Asr time. The congregation was about to set. After the Prayer, my uncle took my hand and approached Huzur Mufti-e-A'zam and requested him:
"Huzur, please accept him and place him in your supervision (make him your Mureed)"
At that time I realised something. Hazrat's spiritual perception is that he spiritually pulled me into his circle and through his supplication he bestowed upon me with the position of Senior Teacher of Jaamia Razvia Manzar-e-Islam. Whatever I am today, and whatever work I am accomplishing; all of it is due to that spiritual perception and supplication of the Master and Possessor of saintliness.
As for my doctorate and secular studies I have to place this also at the feet of my Master. It was the time when my father informed me that the board exam date has been set and I have to return to my hometown. I felt like going to Hazrat late at night but then thought better of it that how can I disturb him. In the morning, before travelling to my hometown, I wrote a letter to Huzur Mufti-e-A'zam requesting him to supplicate for my success. I was about to place the letter into the post box when the horrifying news reached me that Hazrat has passed away. My world was torn apart. My heart was squeezed with emotion and I had felt last night that I should be with Hazrat but I did not do it. And I could not send this letter anymore and I was about to tear it. Then I thought of something and placed the letter addressed to Hazrat into the post box.
The strange thing about the exam was, that it was set in my hometown. And the supervisors were very strict. A boy was found cheating and his exam was refuted. I had not studied (due to sadness) and I knew that I will not be able to pass this exam. But, may my life be sacrificed for Hazrat's spiritual prowess even after he left this world! I received merit in my exam and was awarded with the second position. All of this is due to the letter which I had posted and I was well aware that Hazrat received the letter...eventually.
"Chaman Khaamosh ghamgeen chaand taare Mufti-e-A'zam,
Nahi ab Noor o Nikhat ke nazaare Mufti-e-A'zam,
Rawaa aankho se hain ashkou ke dhaare Mufti-e-A'zam,
Kahaa ho be-sahaaro ke Sahaare Mufti-e-A'zam!"
"The garden is silent, saddened are the moon and stars O Mufti-e-A'zam,
Nor are there any visions of light and luminosity O Mufti-e-A'zam!
Flowing are the rivers of tears from the eyes O Mufti-e-A'zam,
Where are you, O the Support of the supportless, O Mufti-e-A'zam!

"Where is that poor man? Find him!" - An incident from the life of Mufti e Azam
Mawlana Dr. Muhammad Aasim Aazmi narrates that Hadrat Mufti Aziz-ul-Hasan Qibla Khalifa e Mufti-e-A'zam narrated an incident of Qutb-e-Aalam Huzur Mufti Al-A'zam:
"It is the year 1965. Hadrat arrived in Malegaou and at that time I was a Shaykh-ul-Hadith in Darul Uloom Ashrafiya Malegaou. He stayed at the Darul Uloom. It was early morning. Hadrat is present in a vast room in which his mureeds and his admirers are sitting reverently around him. Every person is presenting with his need and plea. Hadrat would inscribe a Ta'aweez and supplicate for each person. Meanwhile, a dispised looking person with torn old clothes and with signs of stress on the face; entered the room and sat down near Hadrat. He greeted Hadrat with Salaam. Hadrat raised his head and replied the greeting. The man kissed his hands and Hadrat asked about his well-being. The man said with tearful eyes:
"Huzoor, I am a poor man. I have to get two of my daughters married. Please issue me with a Ta'aweez so that the wedding can be arranged"
Hadrat replied with softness that you are a poor man. You will surely receive the Ta'aweez. Sit here for a while. Then Hadrat became busy in making Ta'aweez for everyone. After issuing the Ta'aweez to a few people Hadrat looked towards the poor man but the poor man was not there. He searched the whole room but that poor person was not present. Hadrat asked, "Where is that poor man? Find him!"
People stood up and started searching for that person. They went near the Darul ulooms, to the shops and cafe but they couldn't trace him. They returned and informed Hadrat. Hadrat said: "He is a poor person. Ta'aweez needs to be given. Go find him." Everytime he kept saying the same sentence. People became worried. That poor person was a total stranger. Nobody knew him, so they couldn't find him.
The people who were to be the host for Hadrat at their residence were waiting to take Hadrat with them for breakfast. These people informed Hadrat that the car is waiting. Let us leave. But Hadrat replied: "He is a poor man. Ta'aweez needs to be given. Find him." In this way, a significant amount of time passed. Finally Hadrat sat in the car but he kept saying, "He is a poor man. Ta'aweez needs to be given. Find him".
After one and a half hour later, Hadrat returned to the Darul Uloom with these words in his lips, "He is a poor man. Ta'aweez needs to be given. Find him." Saying this, Hadrat entered the room of the Darul Uloom. The entire gathering was silent and stressed. After a few moments, that poor person arrived and when Hadrat saw him, he smiled at him and said, "You have come!" Then Hadrat took hold of some papers and a pen and began writing the Ta'aweez and Hadrat gave it to the poor person.
At the end of the gathering, some people asked about Hadrat's state when he went away for breakfast. They stated that we presented breakfast to Hadrat but Hadrat did not eat anything and kept saying, "He is poor. Ta'aweez needs to be given"
Such attention for the poor people and service to the creation of Allah Ta'ala can only emerge from the Friend of Allah! This is Huzur Mufti Al-A'zam.

bahār-e bāg-e rizwāN tum se hai, zaibe jināN tum ho
You are spring for the air that gives life; you are the morning breeze of the gardens.
The spring for the gardens of heaven is from you, you are the adornment of eternal bliss!
khuda kī saltanut ka do-jahāN maiN kaun dūlha hai,
tumhee, tum ho, tumhee, tum ho, yahāN tum ho, wahāN tum ho
Who is the groom in the kingdom of God,
It is, You! It is, You! Here, are you and there, are you!
haqīqat se tumhārījuz khuda aur kaun wāqif hai,
kahe tu kya kahe koyee, chuneeN tum ho, chunaaN tum ho
Other than God, who knows your reality?
If we say, then what shall we say, you are this and you are that!
nazar ‘arif ka har ‘alam main aya aap ka ‘alam,
na hote tum tu kya hotā, bahār har jahāN tum ho
I saw your world, in all the worlds of the Aarif,
If you were not, then what would have been, you are the prime for all the worlds!
kujū hum khaak uftādah, kuja tum ae shah-e bālā,
agar miṣl-e zamīN hum haiN, tu miṣl-e âsmāN tum ho
Where do we stand with you as we are dead earth [where nothing grows] and exalted are You
If we are like the earth then, you are like the sky
yeh kya maiN ne kahā miṣl-e samā tum ho ma’āzAllah,
munazzah miṣl se burtar-ze har wehm-aw-gumāN tum ho
What have I said, that you are like the sky, God Forbid!
Pure and above are you from all thoughts and assumptions
maiN bhūla aap kī rif’at se nisbat hee hameiN kyā hai,
woh kehne bhar kee nisbat thee, kahāN hum haiN, kahāN tum ho
I forgot, what reach have we with your exaltedness,
It was just for the sake of saying, as where are we and where are you!
hameiN umeed hai rauz-e qiyāmat unkee reHmat se,
ke farmāyeiN idhar â’ao na-māyūs az-jināN tum ho
We have hope for the final day in his mercy
May he say, come here don't feel hopeless from eternal bliss!
sitam kāro, khatā kāro, siyah karo, jafā karo,
hamāre dāman-e reHmat maiN aa ja’oo kahāN tum ho
Sinners, evil doers, mistake makers, transgressors,
Come in to our cloak of mercy, where are you all!
tumhāre hote saate dard dukh kis se kahooN pyāre,
shafī’e âsiyāN tum ho, waqīl-e mujrimāN tum ho
With you being there who else would I tell my pains and grievances
The intercessor for the disobedient ones is you, the representative for the criminals is you!
riyāzat ke yahee din haiN burhāpe maiN kahāN himmat,
jo kuch karna hai abhi karlo, abhī noorī jawāN tum ho
For striving, these are the days, in old age what courage or strength will we have,
Whatever you wish to do, do now, as now O' Noori, young, are you!
faqat nisbat ka jaise hooN haqīqī noorī ho jā’ooN,
mujhe jo dekhe keh uthe miyāN noorī, miyāN tum ho
As I am Noori in relation only, may I become alike in its real terms,
So that all who see me would say, Miya! Noori Miya are you!
[Miya is a customary word in Urdu to invoke a male.]
